Terms of Service

1. Acceptance of Terms

By accessing or using DanceUP (the "Service"), operated by THELDC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, registered users, and studio owners who access the Service.

2. Description of Service

DanceUP is a platform that connects dancers with dance studios, instructors, classes, events, and workshops. The Service allows users to:

• Discover and book dance classes, workshops, and events.
• Reserve private studio space and lessons.
• Purchase class credit packages (one-time or subscription-based).
• Manage bookings and track class attendance history.

DanceUP facilitates connections between users and studios but is not itself a dance studio or instructor.

3. Account Registration

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate.
• Keep your password confidential and notify us immediately of any unauthorized access.
• Accept responsibility for all activity that occurs under your account.

You must be at least 18 years old to create an account. Accounts created on behalf of minors require parental consent.

4. Purchases and Payments

All payments are processed securely by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service.

• Credit packages: One-time package purchases grant a fixed number of class credits to your account. Credits are non-refundable unless otherwise stated at the time of purchase.
• Subscriptions: Subscription packages automatically renew on the billing cycle stated at purchase. You may cancel your subscription at any time from your dashboard; cancellation takes effect at the end of the current billing period.
• Saved payment methods: You may save a payment method to your account for faster checkout. You can remove saved cards at any time from your dashboard.
• Pricing: All prices are displayed in USD. THELDC reserves the right to change pricing with reasonable advance notice.

5. Bookings and Cancellations

When you book a class, event, or studio session through DanceUP, you are entering into an agreement with the studio or instructor, not with THELDC. Each studio sets its own cancellation and no-show policies, which will be displayed at the time of booking. DanceUP is not responsible for cancellations, rescheduling, or disputes arising from third-party studios or instructors.

6. Studio Owner Responsibilities

Studio owners who list their offerings on DanceUP agree to:

• Provide accurate and up-to-date information about classes, schedules, pricing, and availability.
• Honor confirmed bookings made through the platform.
• Comply with all applicable local, state, and federal laws and regulations.
• Handle student data responsibly and in accordance with applicable privacy laws.
• Resolve disputes with students in good faith.

7. Prohibited Conduct

You agree not to:

• Make fraudulent purchases or chargebacks without legitimate cause.
• Submit false, misleading, or defamatory reviews.
• Attempt to gain unauthorized access to any account, system, or data.
• Resell, transfer, or commercially exploit class credits without written permission.
• Use the Service for any unlawful purpose or in violation of these Terms.
• Interfere with or disrupt the integrity or performance of the Service.

THELDC reserves the right to suspend or terminate accounts that violate these Terms.

8. Intellectual Property

The DanceUP name, logo, platform design, and all content created by THELDC are the intellectual property of THELDC. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Content posted by studios and users (such as class descriptions and photos) remains the property of the respective owners.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. THELDC does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, THELDC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service — including losses resulting from third-party cancellations, payment processing errors, or data loss. THELDC's total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to These Terms

THELDC may update these Terms at any time. When we do, we will revise the "Last updated" date above. We will notify you of material changes by email or via an in-app notice. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
